Terms of Service

These Terms of Service (“Terms”) govern access to and use of rankwar.net (the “Service”), including the public ranking, product pages, checkout and related features. By using the Service, creating a listing, or completing a payment, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service and do not pay for a position. Before checkout, you must confirm, by ticking a box, that you have read and agree to these Terms.

Operator and contact

The Service is operated by Enkii, based in France (“we”, “us”, “our”). The Service is provided from https://rankwar.net.

These Terms work together with the public Rules. In case of conflict between the Rules and these Terms, these Terms prevail.

What the Service is

rankwar.net is a paid public ranking. You can pay to list a product website or a profile and to hold a position based on the amount paid, in accordance with the Rules. Listings are paid advertising, not editorial reviews, certifications, endorsements or independent rankings.

A payment buys an opportunity to appear on the board at the position that amount can reach at the time it is processed. It does not buy traffic, clicks, customers, revenue, exclusive placement, a fixed duration at a specific position, search-engine placement, or any specific outcome. Someone else can pay more and outrank you. We may change, pause or discontinue features, including categories and ranking formulas.

Eligibility

You must be at least 18 and able to enter into a binding contract.

If you use the Service on behalf of a company, you represent that you have authority to bind that company, and “you” includes that company.

You may not use the Service if you are barred from receiving services under the laws of France, the European Union, or another applicable jurisdiction, including trade sanctions.

Payments, Stripe and taxes

Checkout is processed by Stripe. We do not collect or store full payment card numbers. Stripe's terms and privacy notice also apply to the payment itself. Amounts are charged solely in euros (EUR). Applicable taxes may be added at checkout.

Position amounts, minimums, and the requirement to pay only the difference to raise your position are described in the Rules and shown before you pay. Completing checkout is an offer to buy a ranking position on those terms. The position is assigned when the payment is confirmed and the listing is written to the board, at the position that amount then supports.

No refunds

All payments are final and non-refundable. A ranking position is a digital service that begins as soon as the payment is confirmed: the listing is created or the position is raised, and the amount paid is counted on the public board. Being outbid later, fewer clicks than you expected, a category you do not like, site unavailability, or a later removal for breach of these Terms do not create a right to a refund.

By completing checkout, you request that we start this digital service immediately and you acknowledge that you lose any legal right of withdrawal or cooling-off period, to the extent the law allows that waiver. Wherever a mandatory consumer right cannot be waived, that right is honoured. Chargebacks, payment disputes, or reversed payments without a legally required basis are a breach of these Terms; we may remove the listing and refuse future use of the Service.

Listings must have valid company/operator details

You may only list a website or profile you own or are authorised to represent. For a website listing, the live site must display valid and current company or operator details identifying who is legally responsible for that project: legal name, and, wherever the law applicable to that site requires it, a postal address, a working means of contact, and any other mandatory information (commercial register, tax details, etc.).

For profile listings (e.g. X), you must be authorised to represent that account, and any website that account promotes must meet the same standard.

Missing, false, incomplete, impersonating, or details we cannot reasonably verify are grounds for removal. We may remove a listing at any time if those details are not correct, without a refund.

Your warranties

By submitting a URL, a profile, or a payment, you represent and warrant that:

  • You have the right to list that destination and to send visitors there.
  • The listing and the destination comply with all applicable laws, including advertising, consumer, privacy, intellectual-property and regulated-industry rules.
  • You are not impersonating another person, brand or company, and you are not claiming a position on behalf of a competitor without authorisation.
  • The destination is not malware, phishing, a fraudulent scheme, or a site whose main purpose is to deceive visitors.
  • The information you submit is accurate, and you will keep it accurate.

Prohibited listings and uses

In addition to the Rules, you may not list or use the Service for:

  • Sexually explicit or pornographic content. Adult-themed (non-pornographic) social networks and platforms are allowed, provided they do not involve sexually explicit content.
  • Chat, invite or group-message links (Telegram, WhatsApp, Discord, and the like), or link shorteners used to hide the real destination.
  • Illegal, fraudulent, defamatory, harassing, hateful, violent content, or content exploiting minors.
  • Counterfeiting, unauthorised streaming, or other infringement of copyright, trademark, or other rights.
  • Interfering with the Service: scraping beyond normal browsing, manipulating click counts, circumventing rate limits, automated position claims without our written authorisation, or reverse engineering except where allowed by mandatory law.

Our right to remove listings

We may refuse, delay, edit, recategorise, hide, or permanently remove any listing, position, or related page, with or without notice, including where we believe these Terms, the Rules, or the law may have been breached; where a rights holder or a platform complains; where company details are missing or invalid; or where we consider that the listing creates legal, security, or reputational risk. Removal does not create a right to a refund.

Fair use and third-party content

To operate the board, we obtain and display publicly available information about listed destinations: names, profiles, titles, descriptions, logos, and profile images. We use that material only to identify the product or profile listed on rankwar.net, to show visitors where a paid position leads, and to operate, moderate and improve the Service.

Under French and EU law, we use third-party names and signs only to identify the goods, services or account being listed, which does not constitute affiliation with, or endorsement by, the rights holder.

rankwar.net, our brand, and the look and feel of the Service are ours. You may not copy the Service, harvest board data for a competing ranking product, or use our brand in a way that suggests we endorse you. Stripe, GoatCounter, and other third-party names remain the property of their respective owners.

Licence you grant us

You grant us a worldwide, non-exclusive, royalty-free licence to host, cache, reproduce, adapt (for sizing, formatting, and ranking display), and publicly display the listing and the public metadata we obtain, for as long as needed to operate, promote, and keep an archive of the Service. You also grant visitors the right to view that listing on the Service. If you want a listing removed, email info@enkii.fr. Removal does not undo a completed payment.

Complaints and rights notices

If you believe a listing infringes your copyright, trademark, image, or other rights, or that a listed site is illegal, email info@enkii.fr with: (1) your name and contact details; (2) the URL of the listing or product page on rankwar.net; (3) the destination URL or profile; (4) a description of the problem; and (5) a statement that the notice is accurate and that you are the rights holder or authorised to act. We may remove or restrict the listing while we review the notice. We may share the notice with whoever made the listing. Repeated or abusive notices may be ignored.

No endorsement, no outcome guarantees

Appearing on the board is not our opinion of a product. We do not verify whether the listed companies, claims, prices, or results are true. Click and visitor counts describe what our systems recorded; they are not a promise that you will get the same result. Your results depend on your position, your destination, timing, and factors we do not control.

Links from the Service to listed sites or profiles leave rankwar.net. Those destinations have their own terms and practices. We are not responsible for them.

Availability and changes

We provide the Service as-is. It may be unavailable, slow, or incorrect. We may change the ranking rules, minimums, categories, or these Terms. If a change is material, we will update the date at the top of this page. Continued use after a change means you accept the new Terms. For a completed payment, the Terms in force at the time of checkout continue to apply to that payment, except where a change is required by law or needed to address a security or legal risk.

Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that listings, names, images, positions, or click counts are accurate or complete.

Limitation of liability

We do not limit liability that applicable law says we cannot limit, including liability for intent, gross negligence, or injury to life, body, or health. Subject to that:

  • We are not liable for lost profits, lost data, loss of reputation, substitute services, or other indirect, incidental, special, or consequential damages.
  • For slight negligence, we are liable only for foreseeable breach of duties essential to these Terms, and only for typical and foreseeable damage.
  • Our total liability for a claim related to a payment is limited to the amount you paid for the listing in question in the three months before the claim.

Indemnity

You will defend, indemnify, and hold harmless Enkii and the people working on the Service from claims, damages, losses, and reasonable legal fees arising from your listing, your destination site or profile, your payment or chargeback, your breach of these Terms, or your infringement of another person's rights. We may take over the defence of a claim; you will cooperate.

Governing law

These Terms are governed by the laws of France, excluding conflict-of-laws rules. If you are a consumer with a mandatory local law that cannot be displaced, that law continues to protect you. If you are not a consumer, the competent courts in France have exclusive jurisdiction, to the extent permitted.

General

If part of these Terms is unenforceable, the rest stays in force, and the invalid part is replaced by the valid term closest to the original intent.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.

These Terms, the Rules, the Privacy Policy, and the checkout details you confirm form the entire agreement for the Service.

Payments, hosting, and analytics involve third parties, including Stripe, Vercel, Supabase, Upstash and GoatCounter. Their outages or decisions are outside our control.
